Terms of Service

1. Agreement to these terms
These Terms of Service govern your access to and use of Zincad, a digital gallery and portfolio presentation platform for artists. By using Zincad, joining the waitlist, reserving a gallery address, or accessing a Zincad page, you agree to these terms.
2. Eligibility and accounts
You must be able to form a binding agreement to use Zincad. If you create an account or reserve a gallery address, you are responsible for the accuracy of the information you provide and for activity that occurs through your account.
3. Artist content
Artists keep ownership of the artwork, images, text, and other materials they upload or submit. By providing content to Zincad, you grant us a limited license to host, display, reproduce, resize, and transmit that content as needed to operate, improve, and promote the service.
You are responsible for ensuring that you have the rights necessary to upload, publish, or share any content through Zincad.
4. Acceptable use
You may not use Zincad to upload unlawful, infringing, misleading, malicious, harassing, or exploitative content. You may not interfere with the service, attempt to bypass access controls, scrape the service at scale, or use Zincad in a way that harms artists, collectors, visitors, or the platform.
5. Gallery addresses
Gallery addresses and handles are provided at our discretion. We may reclaim, rename, suspend, or remove an address if it violates these terms, infringes another party's rights, impersonates someone, or creates confusion.
6. Collector inquiries and transactions
Zincad may help artists receive interest, inquiries, or contact information from visitors. Unless expressly stated otherwise, Zincad is not a broker, dealer, agent, or party to any sale, commission, consignment, or private transaction between artists and collectors.
7. Availability and changes
Zincad may change, suspend, or discontinue parts of the service at any time. We aim for a careful, stable experience, but we do not guarantee that the service will always be available, uninterrupted, or error-free.
8. Termination
We may suspend or terminate access to Zincad if we believe you have violated these terms or used the service in a way that creates risk for Zincad, other users, or visitors. You may stop using Zincad at any time.
9. Disclaimers and limitation of liability
Zincad is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim implied warranties and will not be liable for indirect, incidental, consequential, special, or punitive damages arising from your use of the service.
